Puna Councilman/Candidate Paleka Fined by CSC

Hawaii County Council member Danny Paleka fined by Campaign Spending Commission

On 8/10/16 Campaign Spending Commission (CSC) Elections Assistant Sandy Lee confirmed that a fine was issued to Hawaii District 5 (Puna) County Councilman and candidate Danny Paleka for campaign spending violations. The CSC has yet to release other details. A review of Paleka’s campaign spending reports show several discrepancies amounting to tens of thousands of dollars. The CSC oversees Chapter 11 part VIII of the Hawaii Revised Statutes Campaign Spending Law (http://ags.hawaii.gov/campaign/files/2016/08/HRS.pdf). Reports show that Paleka may have violated one or more Hawaii Revised Statutes regarding campaign finance including:
§11-340 Failure to file report; filing a substantially defective or deficient report.
§11-331 Filing of reports, generally.
§11-337 Reporting expenditures.
§11-338 Late contributions; late expenditures; report.
§11-342 Fundraiser; notice of intent.

On 06/26/16 Danny Paleka amended 28 CSC reports covering July 1st, 2014 - Nov. 04 2014. Some of these reports were amended in 2015 as well. The differences between the reports show tens of thousands of mishandled campaign funds. Differences between Paleka’s original reports and the amended reports include:

Failure to include $24,395.73 in expenditures on the original disclosure documents from the 2012-2014 election cycle.

Failure to include over $9K in campaign contributions on the original reports from the same cycle.

Failure to include a $2,000 donation from “Friends of Kendo [Zendo-name misspelled] Kern,” Hawaii County District 5 Council member preceding Paleka. Other contributions, many larger than $1,000, (some from out of state), were also not reported until this year.

Failure to file a “Notice of Intent to Hold a Fundraiser” (Form CC-8) as required by the CSC, for the 7/17/14 fundraiser held at Aunty Sally’s Luau House in Hilo. The fundraiser was mentioned on 2 occasions in the 2012-2014 2nd Preliminary Primary July 1-July 25, 2014 report.

On 07/30/2014 Paleka recorded $2,699 in contributions from the 7/17/14 fundraiser. The reports from the 2012-2014 election cycle, amended in June this year, do not include the$2,699 contribution. A non-monetary contribution of $275 from Alakai Productions for “entertainment for fundraiser”, is among other contributions listed on the original report from 2014 that is not listed on the amended report.

No offense Amber, but who are you? If you work for the Campaign Spending Commission, why are you using a Gmail? And if you don't work for them, why are you issuing a press release? Just curious.

It's the "Press Release" from Jen Ruggles website. Ms. Shouse is apparently promoting Ms Ruggles. Nothing wrong with that, except maybe the lack of attribution or purpose could be construed, even in the heat of a campaign, as lacking transparency.

Lacking transparency, in the form of a failure to comply, is, at its heart the basis for the complaint against the Paleka campaign.

TomK- Howzit! I'm Pono. I live in HPP with lots of friends and family in District 5. I haven't been on Punaweb in a while, but election time is always the most interesting here. :-)

HiloPuna - thanks for pointing that out. If I were preparing press releases on Miss Ruggles behalf, I'd at least put a quote from her in it. :-P

I heard it was front page this morning, although I haven't seen the hard copy. Yes, I am a friend and supporter of Jen Ruggles, but I wrote a press release (which anyone can do) because I am passionate about economic, social, and environmental justice, not as a favor to Jen. After being tipped off by a council candidate from district 4, who is the one who blew the whistle on Danny in May for not reporting a fundraiser he had in the last election, I started researching his newly amended reports. If you look closely at them, it is honestly shocking. I think that big money in politics seriously compromises the state of our democracy, and if you look at politicians from a county to a federal level and follow the money you can see where special interests come into play. The sheer level and number of inaccuracies on Mr. Paleka's reports, are at the very least, reckless and irresponsible oversight. The people of Puna deserve to know the truth. If it wasn't serious, the Hawaii Tribune Herald, West Hawaii today and KITV would not have reported on it. Mishandling funds like that is serious. Jen Ruggles is a publicly funded candidate btw. I do not wish harm on Paleka, but I do love this island and feel a special calling to care for it. I am not saying that he doesn't care about the well being of the island as well, but people deserve to make an informed decision on who they would like to represent them. On top of mishandling of funds, Paleka voted no on banning Styrofoam (widely supported by the public), voted no on saving Bill 113 (regarding open air cultivation of GMO crops, excluding the papaya, and was widely supported by the public), and voted no on the ethics bill and holding the mayor to the same standards as other county employees. This is a critical time for our environment and for Puna. We are the fastest growing district on our island, have the highest rate of families using welfare in our state, not to mention lava threats and a drastically rising crime rate. We need representatives who will vote for and advocate for the desires of their residents and not special interests. If you haven't voted yet and are undecided, make an informed decision and watch Jen and Danny debate. Just hit the link TomK provided and was surprised that the "Press Release " in support of Ruggles was catagorized by the Editor as "...a smear."

Ms. Edwards goes on to describe her participation in the previous campaign as Palekas opponent and that she has more to reveal later, at a more appropriate time.

I was surprised she called it "a smear" as well.. It is just the facts, which are available to the public and should be when dealing with a representative. If telling the truth about someones actions or in-actions can be considered a smear, than these actions probably weren't so good in and of themselves. My concern is that, even if it was an innocent mistake, it was a $35,000 mistake from what he claims to be a lack of oversight. Could there be the same lack of oversight with our tax dollars?
