Note that HRS 236-16.5(j)(3) would be amended to define "qualified cesspool" to include any which are "shown to impact drinking water supplies or recreational waters".

San Buenaventura was one of the introducers.

As usual, it's all "stick" no "carrot" -- we really need DoH to give us a list of "type-approved" composting toilets.

This is just to appease the EPA !!

It may not work ! jmo

Had to reply to my own post to explain.

The EPA has been putting pressure on the state to do something about the cesspools.So the state finally did something.

I don't think the EPA will allow the state of Hawaii to wait 33 years before making everyone upgrade.

Afraid I have to disagree with you on that. Survey sampling of Paradise Park wells shows that makai wells are already contaminated with wastewater from upslope. As the island population continues to expand and move mauka from population centers, the contamination of existing and new drinking water sources is going to increase.

We don't have soil.

Owners of private property will be able to request state exemptions to the new requirement if it’s signed into law by the governor. Potential exemptions include small lot size, poor soil, steep location and accessibility.

That is true and those of us w/wells have been instructed to make sure we use filters. That still doesn't give me a lot of confidence.
