Supreme Court approves TMT sublease

By some amazing coincidence, right after Kim plans to ask State for $550M, we maybe get some local revenue...

The state Supreme Court ruled that a contested case hearing is not required for the Thirty Meter Telescope’s sublease on Maunakea.

Earlier this year, the court also heard testimony in an appeal of the land use permit, approved by the Land Board last year following a second lengthy contested case. No decision has been made yet on that appeal.

Nope..I predict they will appeal to the US Supreme court. The US Supreme Court may decide not to hear it...but it will probably take 6 months to a year before they say that. And TMT won't wait that long.

If I remember correctly, a good part of the research the TMT will conduct is tied in with the James Webb Space Telescope. JWST’s completion and launch date has been delayed until March 30, 2021, so the TMT can afford to wait longer than their initial cut off date for a final decision on where to build. The delay tactic strategy by opponents will be far more limited in its effectiveness.

Last I heard, TMT was giving money to local Hawai'i universities, so I'm glad they haven't left.

HOTPE is correct in that the TMT wants to be operational while the JWST still has fuel left, which some time up until around 2031 assuming the current delayed launch date is accurate. They also have pressure from Asian partners to build on Mauna Kea and there are no guarantees one or two partners will remain if it moves to La Palma. On the other hand, there are different design parameters required if it's built in La Palma and I don't know when a commitment needs to be made to the organizations involved in those projects, so there may well still be some earlier deadlines. I'm not privy to those discussions so can't really say more.

As for Supreme Court appeals, what's to stop someone from trying anyway, just to further delay things? After all, I believe most reasonable people think most of the anti-TMT lawsuits have all been aimed at delaying the project.

Can't construction go ahead even if there is an (unlikely to win) US Supreme Court appeal? Hopefully the land use appeal is also rejected...

TMT construction could save the big islands economy till tourism comes back. Think the Trade Unions would do something to counter the dozen professional protesters holding up a millions of dollars worth of work
