A friend of mine is asking me:
I'm starting to look into the zoning regulations in Hawaii county, but it's kind of a labyrinth. Does anyone know about the zoning in Paradise Park -- specifically whether you could set an RV on our lot to live in while building our house? I remember seeing a guy in P.P. who was living in a trailer and building his house...but I don't know if he was legal. I guess the questions are:-- Whether staying in a trailer for any length of time is legal;-- Whether it's OK to stay in one while building the house,perhaps for some limited time;-- Whether it could be considered the second permanent dwelling,like a guest house;-- Whether placing it on a concrete pad and hooking it up to a septic tank would make it legal.
Any thought would be appreciated.

There was something about HCC limiting the unit to 30 continuous days after which you would have to leave the property and return the next day to start a new 30 days. HCC does allow mobile housing (Trailers and RVs) to be use as permanent housing if it passes all codes and requirements just like a regular building. Not sure if there are any RV’s or Trailers that are built with required hurricane or earthquake measures. Of course any subdivision rules limiting the time or barring it will come into play as well.
The 30 day restriction thing was part of the proposal of Naeole was looking to eliminate last year.

Section 25-4-10. Mobile dwellings.
All mobile dwellings shall conform to the County building code (chapter 5 of this Code), and the Public
Health Housing Code (chapter 2 of the State public health regulations), except:
(1) When parked in a licensed mobile home park; or
(2) When occupied for dwelling or sleeping purposes outside of a licensed mobile home park for less
than thirty days in any one location.
(1996, Ord. No. 96-160, sec. 2; ratified April 6, 1999.)
Mobile home parks are not listed on page 25-61

What's legal and what's typical practice often don't coincide here. People live in all kinds of structures while building (or not building.) An RV would be rather upscale.
Much would depend on your neighbors.

I am still not sure what the answer is. From what I gather it depends on the subdivision (of course your neighbors) on whether it is allowed. I tried to look up what HPP would allow and I couldn't find anything about this. I went to there website and couldn't find anything. I saw there preposal of what they want the park to become in the future but nothing mentioned what is regulated. Like you said I have seen people living in tents,small shacks, and containers so don't think like living in a motorhome would really be enforced anyway.

Jade, 30 days in one location (the code really does not explain that interpretation on one location....) is the code description, but as Jerry states, many do park longer...
Does anyone know anything about the motor home parked in a bayfront parking lot for most of the last year (after the floods last spring, it was in the abandoned gas station, plugged into their electric, then moved across the street after a month or two... We have wondered if the gas station owner got a high electric bill & shooed the owner away....

hi carey, i have been wondering the same thing... they sure have an ocean view now, heh? i think if they are paying their camping permit fee (10$ per day), then they would be legal... just a question of where to dump the holding tank? i think you can also legally park on your own land if you get a camping permit but again, if no one complains there really isnt an issue.
