I was just looking at the new building code set to take effect on March 28 in Hawaii County. Is there somewhere to get information about what has changed without reading through the entire new code?
I was reading through some of it and noticed a change wrt windows. It seems that windows have to be either impact resistant or have plywood precut to cover the windows. Is that going to be inspected when a house is built?

Are they going to ICC Print it in book or are you going to have to flip between the model IBC, the state revisions, and the county revisions
The IBCs are copywrited so you can't print it yourself

There has been a suit filed today against the County to have an injuction against implementing the new building code until the State OIP can determine if the Sunshine law was violated by the way the County Council handled the passing of Bill 270. OIP is to have received the County's reply to the complaint today and hopefully make their rulings soon. In the mean time, Judge Hara will be reviewing the suit tomorrow and hopefully issue a temporary injuction to prevent the code from becoming effective.
Injustices can be dealt with if you take the initiative to make things right. If the County has to re-adopt the Building Code, it is time for everyone to step up and be vocal when the public hearings are held. It will be very easy for the Council to just correct the administrative errors without going in and correcting the code itself. So, everybody MUST speak out to the Coundil and not just to the blogs. We all must stand up and fight for a just and useable code that maintains the life styles of Puna and all of the Big Island.
April 16th is the deadline for adopting a County code or the State code (amended 2006 IBC) will become the local code. To be honest, this code is far better for the County than the code adopted by Bill 270 and there will be no harm if we have to use it temporarily.

The article is from new york ,The State of Hawaii does not have a lot of the personal rights and government accountablity laws that New York does.

...uh not yet... but there are plenty of other laws in this state that violate the rights of the people snd there will be many more to come. That's what the article is about, stopping bills before they become law.

I see someone has filed for an injunction on 270 if granted the county will not make the April 15 deadline. So I'm assuming the states version goes Into effect, is there any downside to that? It can be amended later right?

Unfortunatly Judge Hara denied the injuction so the new Building Code per Ord. 12-27 has gone into effect as of March 28th. But the suit is still valid and the County has to respond to the accusations by April 18th. at which time a trial date will be set. In the mean time we are waiting to here the findings of the State Office of Information Practices to see if the Sunshine law was broken as we believe. If it was, then the Council has to re-do the last hearing which gives all an oppotunaty to speak up again. Because of the suit, the Council will have to be very good about listening to new Public Comments and pay attention to them. Hopefully we can still get a code that works for the people of Puna, not against them.
In the mean time, any permit application that is submitted after March 28th will be reviewed under the new Building code. If it is determined to be invalid, then all the applicants can request a new review under the Code that is finally developed. Any increased cost that the new code causes should when be reimbursed. Judge Hara would be very interested to know if there is a cost increase since that question caused him to deny the injuction. He could not see any adverse effect of the new code to warrent the injuction.
We need all the information and support we can get to fight this problem in court.
