Would a portipotty need an EIS? Why?

The current situation at Kehena is more in need of an environmental impact study, not to mention a Hazmat crew.

The law was written to protect not only the environment, it also address issues of culture, traffic, historical, congestion, resources, etc. The intent was to make sure that if an EA was required, it was conducted. Likewise, if an EIS was required the EIS is conducted. However, it is not possible to cover every possible scenario so generalities were used and those generalities open up the process to challenges.

In order to cover the bases and adhere to the law, they had to make sure that no doors were left open or unguarded so a developer could slip through. The law also wanted to make sure government didn’t abuse their powers and discretion so safeguards were installed as well. Unfortunately, those safeguards could also be applied to many other projects, some as benign as a porta-pottie.

All it takes is a half knowledgeable attorney or developer to use the protections in the law to challenge the process against almost anything. Could it happen? Any person with half a brain can raise a legitimate issue over a porta-pottie and muck up the works.
