My understanding is the court ruled the process hadn't been completed prior to the permit, not that it wasn't meaningful.

The end of his testimony ends with a threat:

It's also interesting to note Ashida's cross examination at about 152:30 on Jan. 12 Part 1 in regards to compromise and the fact the Dr. Osario's own brother is a supporting member of PUEO and the TMT. It's worth listening to as well.

Eric1600 - thank you for the link to Dr Osorio's written testimony. I've been working pretty much day and night recently and haven't had a chance to read it, but appreciate the reference. Didn't want you to think I ignored your post and will look at it when I can.
