Like a few have done, I'd also like to commend Judge Amano on the way she handled the entire hearing, with being fair and stringent with all parties. just my opinion

actual building of large structures like the proposed TMT building(s) requires proper egress in order to transport large pre-engineered segments of said structure(s)

TMT requires electricity and bandwidth too, so obviously any infrastructure build-out is only to support TMT, and cannot ever be used for any other purpose?

That's true. But it doesn't mean the road was built specifically for construction of the TMT. Larger components might now be delivered because the road was built. Once again we need to look to our good friends, correlation and causation.

Protest supporters can only pray that the Protectors hold out long enough to get rightful entitlements which weren't even on the table prior to the protests and that is something.


So are you saying the Protectors find these places "sacred," right up until the price is right?

Aloha Mr. Tom. You are correct, with one exception as I understand: Judge Amano's decision will be submitted to the Court for review (as it was their ruling to hold this hearing), and then to the BLNR for consideration.

The unknown (besides the obvious decision from Judge Amano) is the appeal process which is inevitable, no matter her decision. (*Add a few weeks/months to an appeal process).


This is the process going forward, and no the preliminary ruling won't be reviewed by the Hawaii Supreme Court during this process. That won't happen until the inevitable appeal happens after retired judge Amano issues her final decision, and its accepted by the BLNR.

Next, court reporters face an enormous task of completing the written transcript. That could take five to six weeks, said Amano, a retired judge.

Afterward, the parties, which at the start totaled nearly two dozen, will have 30 days to submit their proposed decision, including findings of fact and conclusions of law. Amano said she will finish her decision following a two-week period in which objections to proposed orders can be made.

Federal Highway Administration, State Highway, and Defense Access Road funding have made the Saddle Road improvements a reality. The DAR funding was used to improve a 13 mile stretch of Saddle Road between m.m 28 and m.m 41

After that they get about two weeks to address anything else that was filed. This puts the final decision date sometime around June. Does that sound about right?


The first CCH hearing officer took over a year to issue his preliminary findings, which the petitioners had an opportunity to rebut before the BLNR could take action. This is why it took from 2011 until 2013 before the BLNR finalized the (now invalidated) CDUP.

In some ways I think the Saddle road project was done with a TMT project, money and more in mind.

Sen Inouye may have been part of many secret meetings that helped spell out our islands future over the years to come. He also loved the military, astronomy, and earmarked money. Those years of earmarked millions may have had grander ideas or plans attached to them than what we the general public was ever made aware of. Senator Inouye did not just think or plan for 5-10 years in advance, more like 50-100 years. jmo

Fifty foot wide pieces of the TMT would need to be brought up the mountain from the ocean. This was known by some like the TMT reps and Island Senators more than a decade ago, as was the differences i EIS reports. Millions worth of Infrastructure improvements would have had to be done in Chile or India also if the TMT project was destined there, probably hundreds of millions more. jmo's

Please don't stop there. Tell us more about who attended these secret meetings, what they said, and some of the cool, futuristic stuff we'll get in 50 or 100 years assuming the protestors don't roll rocks in front of it.

Wait, I know, I know! To get around any future protests one of Inouye's secret plans must have beeen to finally give us Hawaiian Flying Cars, right? Cause they can hover right over boulders in the road?

There were so many ridiculous statements made by various witnesses, they could fill a book. I've already mentioned the wacky "star priest" and the shape shifting female lizard with human blood which can only be seen by Bonnie Pualani Case's daughter.

But there's another claim which is really outrageous. Someone was being questioned about the effects of the TMT on the protesters, and claimed that the level of trauma was the same as US veterans who fought in Iraq.

It may have been Bonnie, I'd have to check the recording.

Since when does getting arrested and eventually being cleared of all charges compare to fighting door to door in Fallujah, seeing your buddies killed right in front of you and then having that scene replayed night after night in your sleep?
