HPP BIZ: Part the second
Since another HPP thread is getting nasty again, I will point out the Punaweb rules you all signed up to. I'm not Rob, but if I was I'd have lost patience by now, you are all making HPP look much worse than it is.

This IS HPP Biz. A board of director and the general manager filed lawsuits of their own free will and have taken control of the HPP office and HPP business. That's fact can't be disputed. The former director Creeley didn't file a lawsuit but there's been no board meetings for several months because of him, costing HPP in legal expenses. That's fact can't be disputed. We don't know who's signing checks for HPP. That's fact can't be disputed. The website is in control of these three people. That's fact can't be disputed. People who are suing HPP shouldn't have control of HPP business. That's fact can't be disputed. The former board and the current board are in legal battle. That's fact can't be disputed. We need a trustee ASAP.

Leo, You need to get your facts straight.The president of HPP is suing HPPOA to take it into receivership. You stated "We need a trustee ASAP"

Perhaps that would have happened but the 2 directors who seem bent on destroying HPP have filed motions opposing the appointment of a trustee or receiver.

We need a trustee ASAP.

Better idea: dissolve HPPOA, let the bondholder pursue every landowner for their "full faith and credit". Sometimes the best way to fix something is to just go ahead and break it the rest of the way.

Leo you are correct and Obie's statement is completely false.
Waiting for the court's rendering in the evidentiary hearing, which has yet to take place, regarding Crelly's resignation is what's holding up HPP business. As previously reported in the communication to members here on PT 4 Nov 2019, there is NO legal document in our possession that states there can't be any board meetings in the interim. The two directors have been blocked from all HPP business.

It was HPP's attorney that suggested a trustee during the last telecon between the judge and both attorneys. The judge at this time still hasn't assigned a trustee.

Snippets from the original post here on PT 4 Nov 2019:

"There has been two phone hearings in which the judge declined the plaintiff's request for receivership. There was a court hearing for the partial summary judgment regarding Crelly's resignation and the court has yet to determine whether he's a director. There will be an evidentiary hearing coming up in the near future in which a judge will determine Crelly's resignation, and in the meantime Craig Crelly's director seat is in limbo. Crelly claims he resigned on 19 Jun 2019 in solidarity with the other 4 directors who resigned.

The judge and the attorneys for plaintiff and defendants recently agreed that a trustee will be assigned soon, chosen by the judge, to manage HPP business. This is a positive thing for HPP as this will put an end to the era of a few people managing HPP without legal authorization."

The general manager and officers are listed as a signatories on the Association's operating accounts, and that dual signatures shall be required for anything over a certain amount as determined by a
resolution adopted by the board.

I don't see where it says a director or the general manager can sign large sum checks without the board approving it first. If there's been no board meetings how does that happen?
Kauwauhua's lawsuit was posted on facebook. It was clear to anyone with average reading comprehension skills that Creeley's resignation is an integral part of the lawsuit.
I just want to know what's been going on with my road fee money for the past few years. I used to get financial reports in the mail and at members meeting. It steadily got worse. Last year there was absolutely nothing.

All expenditures occurring or that have previously require board approval have had board approval, why believe otherwise? There were motions and votes at the past meetings I attended between October 2018 and 2019 it’s any new expenditures that aren’t considered daily operations that would have to be put on hold for board approval verifying through a motion and majority vote.
