Many people do the same thing, drivers are expected to be aware of their surroundings, including pedestrians, and anyone who uses that transfer station knows that people who are not dumping whole truckloads walk up to the chute all the time. There will often be people back there, which is why there is a concrete curb painted bright yellow creating a 6 foot car free zone between the chute and vehicles. This person backed up with enough force that they "jumped the curb" and killed someone who didn't expect a vehicle to come at them there, responsibility for this tragedy belongs solely to the driver, not the victim for walking a bag of trash up to the chute.
