Must be getting competitive for the fish takers, for them to react like that with other divers in the water. The most tropical fish I know of is held at the Geothermal plant swimming around in their holding tanks. It would be cool to be able to buy some local reef fish from Geothermal in the future. I am not sure why or how they are able to hold or keep these tropical fish?. Do they hire local fish collectors?.

The reefs are getting stripped. DNLR is the most ineffective useless department in the state.

A plea bargain got him a "deferred" 6-month prison sentence, which means no time served at all if he manages to avoid attacking anyone for a year. He pleaded guilty to "second-degree terroristic threatening", which I had no idea was a thing. After watching the video, I think he should be charged with being a moron. If you're going to attack someone, don't do it while they are pointing a video camera at you.[xx(]

I hope that the dive certification agency that issued Jay Lovell his dive certification stands by their training and revokes his certification, for life!

I agree ,, tropical fish should not be so easily or generously taken from our local waters ,, or anywhere for that matter ,,, we have already done way to much damage to mother nature .

The defendant pled No Contest to Terroristic Threatening in the 2nd degree. Defendant's motion for deferred acceptance of no contest plea was granted by Judge Ibarra. Defendant was placed under adult supervision for the period of 1 year with the following special conditions:

1. Follow all reasonable instructions given by your probation officer.

2. Be committed to the custody of the director of the Dept. of Public Safety for a period of incarceration of 6 months, with all 6 months suspended.

3. Obtain an anger management assessment as directed by your probation officer, at your own expense, in accordance with your ability to pay, and follow any recommendations for treatment to clinical discharge. Obtain the assessment within 30 days of the date of this order.

4. Pay a compensation fee in the amount of $55.00.

5. Pay a probation services fee in the amount of $75.00.

6. Pay the entire amount not later than 60 days from the date of this order.

7. Sign waiver of confidentiality forms to allow your probation officer to monitor your compliance with any anger management assessment or any other treatment required by the terms and conditions of your probation and your probation officer or the court.

8. Sign the terms and conditions of deferral. Upon verification that the terms and conditions of deferral have been executed, bail conditions shall be cancelled.

9. Contact the Adult Probation Department at 77-6399 Nalani St., Ste. 3-A, Kailua-Kona, Hawaii // 443-2191 no later than 2 business days of sentencing to schedule your first appointment with a probation officer.

10. Upon completion of the period of deferral, the Defendant shall be relieved of any obligations imposed by the order of the court and shall have satisfied the disposition of the court except as to any action to collect unpaid fines, restitution, attorney's fees, costs, or interest (HRS 706-630); thereby, is restored to such rights deprived pursuant to section 831-2 of the Hawaii Revised Statutes. The charge(s) will be dismissed with prejudice. This condition shall not apply if the Defendant's term of deferral has been revoked.

Court granted the State's motion that Defendant report for ID processing no later than 2-27-15.
