Universal Citation: HI Rev Stat § 19-3.5 (2013)

§19-3.5 Voter fraud. The following persons shall be guilty of a class C felony:

(1) Any person who knowingly registers another person to vote when that person is not entitled to register to vote;

(2) Any person who knowingly votes when the person is not entitled to vote;

(3) Any person who knowingly takes an oath in this title prescribed or authorized by law and wilfully makes any false statement of fact while under oath therein; or

(4) Any person who wilfully makes a false answer to any question asked of the person while under oath in this title prescribed or authorized by law. [L 1990, c 115, §2]




Lets see....... I have a house in District 5 and I work in District 4. I spend more time at work than at home. I prepare meals at work. I eat, brush my teeth, cleanse myself, and doo-doo at work. To coin a phrase; I live at work. I feel I could register to vote in district 4 where I work and spend most of my life. I only get one vote. Where is the fraud? Who is the victim? My domicile is somewhat subjective. Notice the statute has words like "knowingly" and "willfully". Difficult to prove for all but Jedi mind controllers.

Now, if I tried to register in both districts and get multiple votes I'd be guilty of defrauding the County. If I registered as someone else; guilty....... But I guarantee you that Tiffany will eventually have all charges dropped, because like her or not, she has defrauded no one...... She was registered at a single address, and was entitled to a single vote. None of that is in question. The prosecutor has to prove "intent" to defraud and that just ain't gonna happen.

When the general election is over and Mitch isn't so worried about stirring up the centipede nest of haters, He will find it prudent to not spend anymore time or money prosecuting someone else's vendetta. No harm, no foul Baby!

She may have been registered at one address, but she claimed another address as her home, due to the property tax exemption. Between her and her husband, that is 3 different places they claimed to live in, at the same time. The law allows you to claim one of them as your primary residence, not to be able to pick and choose which residence suits each purpose you have in mind.

She has engaged in what many consider to be vendettas on her blog in the past. She has threatened to sue people on this forum for questioning her journalistic abilities, citing interference with her ability to make a living. Indictments are serious business. Sometimes karma bites.

Part of the problem is different governmental bodies define primary residence differently. So the IRS, the Elections division, and the property tax people could all define your primary residence differently, using different criteria, so you could be claiming one primary residence under IRS rules, a different one for voting, and a third for your property taxes. However, each of these only allows you one primary residence at a time under that agency's rules. I know someone who works on Oahu 4 days a week, their family lives and goes to school in Puna and they are registered to vote in Puna at what they consider their home, but they take their federal deduction on the condo in Honolulu. Legal under everyone's rules, but contradictory on the surface if you don't dig deep.

What amazes me is that someone would run for office without cleaning this sort of thing up. How could anyone be so naive as to think it wouldn't get brought to light? Same for Paleka running for re-election without cleaning up his campaign finance reports from the last election.

Yup. She messed up her addresses. Should have cleaned that sh*t up. So how much time and money is Mitch Roth going to spend on proving that she willingly and knowingly did it with the intent to "defraud" the county? What was she attempting to defraud the County of? What exactly was her motive? The fact that her detractors probably consider her crazy is probably enough to wedge a shadow of doubt into her defense.

I guarantee.........Like her or not, Karma or not,................ Charges dropped.

Aloha Everybody! I know I haven't discoursed with y'all on pw on this subject for a long time but the Snarkle brought me out of retirement.

So Snork,'charges dropped' and your guaranteeing it? I'm sure Tiffany is happy to read that. She should sleep better now. Maybe you can try to get on the jury and really guarantee it. Or perhaps go throw some extra dollars at her gofundme account. If you haven't already she could use it for the attorney she selected is the BEST and well connected but that will cost her a small fortune . Perhaps Brian will give her a kamaaina rate. Let's all call him and encourage him to do that.

The offices of the County Prosecutor and State Attorney General are going hot and heavy on white collar crime which cost the state a lot of money in lost revenues and all that other good stuff. There is no dichotomy in crime and our Prosecutor is suppose to fight it all unless it is civil. Crime is crime. When it comes to the question of election fraud which is a white collar crime it must be sorted out in the courts that is why we have trials.

So Snork, your position is that they are never going to prove motive? They don't need to Tiffany does that just fine herself. Read the 350 page police report and you will see what they saw which is MOTIVE. And are you intimating that all of these citizens and legal professionals who are bringing this case forward are doing it against Tiffany to satisfy a vendetta from what Tiffany likes to call me “a toothless black woman” ? Do you really believe that?

I feel so sorry for Tiffany that she could get herself into such a predicament as this but perhaps its all my fault? What say you Snork? Perhaps you could visit her and console her if you knew which residence she was calling “home” these days.[Wink]

How much will the County Prosecutor cost the state in pursuing this case all of the way through to a trial? How much does a 350 page police report cost?
