dog purposely run over in HPP New Year's Eve after
#1
A guy in a white Jeep Cherokee/Laredo with Oregon plates (2nd letter "T", 3rd letter "W") deliberately plowed down a dog in front of me while I was walking on Paradise near Beach Ave around 5-5:30pm today.

He didn’t even stop.

He did roll down his window & yell that the dog should be on a leash.
Only it wasn’t my dog – it was a neighborhood dog that got loose. I never saw it before–it was walking ahead of me & my dogs (which were all on leashes). The guy could have easily gone around the dog but he purposely ran it over & kept coming straight at me.

The dirtbag didn't even turn to see if the dog was dead or alive.

I'm horrified. have no idea who owns the dog. I feel awful.

That sucks! Years ago I was driving down a street with parked cars all along both sides and a dog darted out and I could't avoid running it over. I stopped and spoke to the owner. The dopg was still alive and I said he needed to bget to a vet right away.They said they couldn't, so I took the dog to the vet myself.The vet took the dog in. I don't know what happened to the dog, but I felt terrible.I can't imagine some heartless sob running down a dog on purpose.

I know about where you are talking about.

Well, that sucks, but thanks for letting the neighborhood know about what happened.

spunky, if you have not already then please do jot down all the details you can remember describing the driver (age, race, facial hair, any characteristics) and vehicle as best you can and then call the incident in to the cops. It is good to build a record on this sort of person as, alas, it is unlikely to be an isolated incident for him.

Is there a leash law in HPP? There is in Lelani but I am unaware of one here.

Whether there is a leash law or not, the drivers actions seem to me to constitute reckless endangerment (he drove straight at you) and perhaps terroristic threatening (deliberately killing someone else's pet in front of them; he thought the dog was yours). Since pets are considered property under the law there would also be destruction of property. Animal cruelty. And so on- the police should have enough ways to make some charge or other stick if a license plate can be connected to the description of the vehicle and driver.

There is an HPP Neighborhood Watch meeting tomorrow morning (Saturday, 01JAN2011) at 9am in the HPP hui. Please do come if you can. I will ask everyone there to put the word out through the Neighborhood Watch grapevine to look for a "white Jeep Cherokee/Laredo with Oregon plates, 2nd letter "T", 3rd letter "W"."

How awful, horrible, sick. [Sad]

Hawai'i Law on Cruelty to Animals. (I remember when this was passed, being shocked at how lax the laws were prior to this.)

quote:
§ 711-1100 - 1110.6

Summary: Under Hawaii law, a person commits the misdemeanor offense of cruelty to animals if the person intentionally, knowingly, or recklessly overdrives, overloads, tortures, torments, cruelly beats or starves any animal, deprives a pet animal of necessary sustenance, mutilates, poisons, or kills without need any animal other than insects, vermin, or other pests, or engages in animal fighting enterprises.
Act 114, Session Laws 2007, amended this section by, among other things, defining "pet animal" as a dog, cat, domesticated rabbit, guinea pig, [domesticated pig,] or caged birds, so long as they are not bred for consumption.

Act 114 strengthened Hawaii's animal cruelty laws. The legislature found that violence, whether against humans or animals, must be not tolerated in our society. Evidence suggests a link between animal abuse and the commission of violent acts against humans. Hawaii is only one of nine states in the United States without a felony offense for domestic animal abuse. The legislature also found that pet animals provide a close emotional bond and relationship with their owners and family members and friends. Violence and harm committed against the animals have a significant emotional impact on their owners and family. The felony provisions of Act 114 protected pet animals. Conference Committee Report No. 29.

§ 711-1108.5 Cruelty to animals in the first degree.

(1) A person commits the offense of cruelty to animals in the first degree if the person intentionally or knowingly tortures, mutilates, or poisons or causes the torture, mutilation, or poisoning of any pet animal or equine animal resulting in serious bodily injury or death of the pet animal or equine animal.

(4) Cruelty to animals in the first degree is a class C felony.

Laws 2007, ch. 114, § 2, eff. June 1, 2007; Laws 2008, ch. 111, § 2, eff. May 27, 2008.

§ 711-1109 Cruelty to animals in the second degree.

(1) A person commits the offense of cruelty to animals in the second degree if the person intentionally, knowingly, or recklessly:
(a) Overdrives, overloads, tortures, torments, beats, causes substantial bodily injury, or starves any animal, or causes the overdriving, overloading, torture, torment, beating, or starving of any animal;

(b) Deprives a pet animal of necessary sustenance or causes such deprivation;

© Mutilates, poisons, or kills without need any animal other than insects, vermin, or other pests;

(d) Keeps, uses, or in any way is connected with or interested in the management of, or receives money for the admission of any person to, any place kept or used for the purpose of fighting or baiting any bull, bear, cock, or other animal, and includes every person who encourages, aids, or assists therein, or who permits or suffers any place to be so kept or used;

(e) Carries or causes to be carried, in or upon any vehicle or other conveyance, any animal in a cruel or inhumane manner;

(f) Confines or causes to be confined, in a kennel or cage, any pet animal in a cruel or inhumane manner;

(g) Tethers, fastens, ties, or restrains a dog to a dog house, tree, fence, or any other stationary object by means of a choke collar, pinch collar, or prong collar; provided that a person is not prohibited from using such restraints when walking a dog with a hand-held leash or while a dog is engaged in a supervised activity; or

(h) Assists another in the commission of any act specified in subsections (1)(a) through (1)(g).

(2) Subsection (1)(a), (b), ©, (e), (f), (g), and (h) shall not apply to:

(a) Accepted veterinary practices;

(b) Activities carried on for scientific research governed by standards of accepted educational or medicinal practices; or

© Pest control operations conducted pursuant to chapter 149A by a pest control operator licensed pursuant to chapter 460J, if the pest control is performed under a written contract.

(3) Whenever any animal is so severely injured that there is no reasonable probability that its life or usefulness can be saved, the animal may be immediately destroyed without creating any offense under this section.

(4) Cruelty to animals in the second degree is a misdemeanor.

I bolded the sections that seem relevant.
I would like to think what happened would be first degree cruelty, but I sort of think it would be second degree, as there was needless killing, but not budding serial killer level of torture and mutilation.

FYI Aloha Steven - thanks for the heads up re the meeting but probably won't make it at 9am on New Years. Wink

this dog had been loose on 1st street when I first was walking my dogs. An older couple was walking with the dog (I thought it was theirs). They said it belonged to someone on 1st street and they were walking to the house to see if the owner was home. I passed the couple again on my way back and they said the owner wasn't home. The couple kept walking on 1st street.

The dog followed me along 1st street although I was trying to shoo it away from my dogs. I crossed Paradise and walked along it heading toward Beach. The Jeep turned from the Hilo side of Beach Ave and headed toward the highway. The Jeep driver saw me and my dogs as well as the dog ahead of me. I thought for sure he would stop or at least veer around it but he purposely went head on and hit the dog. The dog ran off.

The thing is the driver thought it was my dog because he yelled at me that it should be leashed. I had to get out of the way of the Jeep. The guy was haole and a Japanese/local lady with long black hair was in the passenger seat.

Of course sidewalks on Paradise would be nice but that's a whole other issue.

Wow, I really hope you report this all to the police and the humane society. How many cars fitting that description can there be here? If you had to get out of the way of the Jeep to avoid being hit that is a major issue in itself and this person should be prosecuted and stripped of his license even if there was no issue regarding any dog. Disgusting.

"The Jeep driver saw me and my dogs as well as the dog ahead of me. I thought for sure he would stop or at least veer around it but he purposely went head on and hit the dog. The dog ran off."

So if the dog ran off, it probably didn't get hit.

Maybe that loose dog killed his chickens or threatened his family as they tried to walk out their front door one day.

Obie - the dog definitely got hit. I heard the impact when it's head hit the front grill and saw it's neck go backward and heard the thud when the dog hit the ground. It's not something you'd forget. The dog ran from the scene but it was definitely hit.
