This reads like a thinktank lobbying against taxes. Nice try, Koch Industries.

They actually do include marijuana legalization/decriminalization and marriage equality as factors. But here's how they rank under "personal freedoms" (which themselves are only 32% of the total score):
Marriage Freedom (2.1%)
Marijuana and Salvia Freedom (2.1%)
Gambling Freedom (2.0%)
Education Policy (1.9%)
Civil Liberties (0.6%)

compared to:
Gun Control Freedom (6.6%)
Tobacco Freedom (4.1%)

Not surprising that the top five are North and South Dakota, Oklahoma, Tennessee, and New Hampshire.
