(a) The subdivider shall grade, drain, and surface all streets constructed after December 21, 1966 as shown
on his plat, except reserved dedication for future street purposes, so as to provide access for vehicular
traffic to each lot of the subdivision.

Are you thinking:
Ordinance 1944-136 citing "building lots"?
Even in the 1970's and 1980's to this day a "building lot" is within a housing subdivision.
Or is there another ordinance more specific to agricultural lots you were citing?

The basic County ordinance I refer to is ORD 1953-128.

AN ORDINANCE AMENDING SECTION 9 AND SECTION 16 OF ORDINANCE N0. 58 AS AMENDED, PERTAINING TO THE REGULATION OF THE SUBDIVISION OF REAL ESTATE IN THE COUNTY OF HAWAII BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF HAWAII
Section l Paragraph 7, Subsection A, Section 9, of Ordinance No 58 as amended is hereby further amended to read as follows
7. Pavement of streets and roads within the County of Hawaii.

All streets and roads hereafter constructed within
the County of Hawaii shall have an approved six (6)
inch base course and three (3) inch asphalt macadam
pavement or two (2) inch asphalt concrete pavement
which shall conform to the standards as set forth
by the Department of Public Works"

Section 2. Paragraph 8, Subsection A, Section 9 of
Ordinance No 58, as amended, is hereby repealed o
Section 3e Section 16 of Ordinance No. 58, as amended,
is hereby amended to read as follows
"Section 16. Penalty.
Any person, firm or corporation, violating or failing
to comply with the provisions of this ordinance, shall
be punished by a fine not exceeding five hundred
dollars. The continuance of any such violation after conviction
shall be deemed a new offense for each day of such
oontinuance
Section 4e This ordinance shall take affect upon its
approvals.


The CoH allowed over 80,000 lots to be subdivided and offered for sale with approx. 750 miles of substandard roads. Many of those road miles were non existent at the time the lots were approved for sale. The County was in violation of it's own codes... and still is.

Uh... ordinance 58 is necessary to comprehend what any of those amendments are in reference to.

Its not that hard to understand. But go read Ord. 58 if you like and then track the amendments through the last fifty years like I did. The amendments of ORD 1953-128 were and are in effect since 1953.

The initially cited ordinance amendment is in reference to replacement of subsection 1, paragraph 7, subsection A, Section 9 of ordinance No. 58.

The second amending portion is in reference to Sec 3, sec 16 of ordinance 58.

Without ordinance No. 58 to apply the above amendments, this means zip, nothing. We have no idea what these are effecting or in reference to.

That, my friend, is your problem. Ord.58 is still on the books as the base reference code on the subject.

But just as a suggestion consider the title:

PERTAINING TO THE REGULATION OF THE SUBDIVISION OF REAL ESTATE IN THE COUNTY OF HAWAII

I would therefore suggest you do have an idea of what these are effecting or in reference to.

Your citation is from 2009. The land we are discussing was mostly subdivided in 1959. Think.
