Puna home invasion earns 10 year sentence

Once is enough for me, won't be taking my chances. Don't want to get shot, don't break in my house. Pretty simple.

Any breaking and entering with someone home is a HOME INVASION, wether the criminal knows or not. That is a felony. Protecting your home is covered under the Castle Law. You only need to feel you or your family is in danger physically.

These are the laws.

Good luck! Just remember some of us might be on the jury of your peers, and we don't all see it the way you do. The law is the law, but there are many different interpretations.

seems to me if you just give people a slap on the wrist for invading someones home, then that will encourage home invasions. see how many home invasions happen when it is public knowledge that the owner can shoot you dead if you're in the house.

There was a case where a guy in lower Puna had a masked, armed, neighbor prowling on his property, the prowler shot his dog, so upon hearing the gunshots the homeowner grabbed his shotgun and shot in the direction of the gunfire. Prowler was killed, homeowner was vindicated in his claim of self defense due to the prowler's possession of a .22 caliber weapon.

The "Castle" defense is only valid in Hawai'i if the intruder is armed, and, or, threatening harm with a weapon. In the above case the intruder was armed with not only a firearm, but some form of bladed weapon. He also shot the dog, thus giving the homeowner reason to fear for his family's safety.

If you shoot an unarmed intruder you have escalated the violence to the point where you risk being convicted of a felony.

Common knowledge dictates that a person conceals the facts the the event and commits fraud?

I am not too fond of Punaweb being a vehicle for advocating breaking the law.

I would not fail to defend my loved ones If someone was forcefully trying to enter my home.
First I would shout a verbal warning
then I would pump my shotgun.
If needed fire a warning shot.
If the intruder keeps coming he gets shot.
If I get arrested for that then so be it. period
One Thing I can always be sure of is that things will never go as expected.

I would hazard a guess that every single person (who's here) on this message board has been stolen from at least once while living here. For me, it was some kind of "metal roof cutter" worth 400 dollars that was left here overnight, and I didn't even realize this thing was valuable. (left here by roofers- probably an inside job) I make sure I have very little to steal, because it certainly is rampant.
