Even better "dumb question". If $43 of the $85 is lost to "overhead", what happens if dues go to $0 after receivership?

My understanding is that if/when Orchidland goes into receivership, the court-appointed receiver has more leverage to make decisions and has stronger legal leverage to collect payments from non-payers. Also, the "overhead" paid to the receiver will probably be more than $43...

Kimo, I reread the original motions to refresh my memory of the meeting where the road fee was increased from $85 to $150. There had been discussion about how keeping the gravel roads passable was so expensive that the chip sealed roads were being neglected and therefore crumbling. The increase was meant to stop that bleeding, if only temporarily. According to the minutes: "Ralph Boyea moved to increase the MRMA to $150, at least $65 of which will go toward resurfacing our chipsealed roads that can still be repaired. This increase will be in effect for two years. Derek Shimizu seconded, and the motion passed by a vote of 25 for, 16 opposed, 1 abstention."

I interpret that to mean that after two years, the increase goes away but the base rate remains. But I'm sure good lawyers would take someone's money to make a compelling case on either side of the issue.

The way I see it if it goes into receivership, the appointed person will take the fund that are available, use them on the roads on a worst to least base repair. Also the appointed person would initiate tax liens on those that have not paid, arrears included. A tax lien for road fees would stay attached to your property tax bill until paid in full, which then gives the County Tax Board authority to garnish wages if necessary to satisfy lien. Do the people want this? My personal response is a big NO. I would personally pay the fee, and then maintain my own strip in front of my property until the majority of the roads are fixed, which would give me the impression that the Board is on the downhill side of road maintenence, and can now absorb my road front maintenence within their budget. But that is just me.

not sure of hawaii state law - have yet to see an agency try to collect on a lien tax or mechanics by wage garnishment

liens usually stay attached and theoretically are cleared at title transfer - tax liens and attorney fees come of the top in my experience if there is anything left - mechanics and labor liens paid out last

That is correct, and why its important to have a proper title search and insurance. Without a proper title search, the lien would transfer to the new owner, which would really suck if the lien was greater than the value of the property. The point of the insurance is that if they missed or couldn't find a lien, it's paid by the title company.

My bad, got cases mixed up, getting old in da brain Smile. Only governmental agencies can attach a tax lien, as a judgement, unpaid traffic citations, or Code Enforcement fines such as the owner of the past "house of cards". Mechanics liens are attached to the property title the same as a mortgage note to be satisfied at time of sale or transfer. Still believe a solution is here somewhere between the lines, and the pile of cold patch is a start. Potholes before lawyers!

In other news, it looks like they're getting ready to re-pave Orchidland Drive from 130 up to 37th. Land has been pushed back about a foot or two on both sides of the road all the way up the hill. Keeping fongers crossed, because the road is like Swiss cheese these days...
