HPP General Membership Snafu?

I am really thinking that it is getting really weird here...
the OP was not abusive, just informing of the situation, & cause.

I do think that it would be far EASIER, as the OP had stated, to cancel on the Hui rental, and keep the general meeting date, but I really DO NOT have any idea what the contract between the ASSN. and the renter of the facilities states (many have some wording for this type of occurrence,
It does seem that the membership meeting would have been a first booking...but I AM NOT an expert by any means...and the contract would have much more legal weight than anything else....

AS to the zen thing...well that could go both ways, as a truly zen thing would be that the party goers would realize that no positive karma would be had in making what was an obvious mistake into any conflict, and would see that this mistake could be easily corrected by changing their venue....

So this is really nothing about mainlander/eastern zen, it is about a mistake, and how to best resolve it...pointing fingers & placing blame are not the way...
working with everyone to resolve this in a positive manner is!

ADD: if the invitations have already been sent there are ways to work around the corrected invite...little thinngs like the Hui assisting in the resending... but this may not even need to be done if the invites have not been sent & just need a correction, though not perfect, but as many have stated, the Zen way (though this is WAYY early for most, some invitations do go out this early as 3 mos is outside the "Post Protocol" for most invitations: http://www.emilypost.com/social-life/inv...en-to-send )

ADD 2: REMEMBER the general meeting is not a "Little thing" it is a meeting that is set for all ~8,800 lot owners...any one of which could have planned to be at that particular meeting at that particular day...and have a legal right to, based on the bylaws...so changing their meeting is one of the largest changes you could make
This one of the largest property owner meeting changes ever, anywhere, something some have a very hard time grasping...this is a huge thing to do!...

But of course there is a very easy way to correct this, use the rental monies to rent a large tent, place it on the Hui property, next to the party venue & the only problem will be a lot of parking in that one spot!

The truly best way to correct this!

It makes more sense to cancel someones contract for a momentous event; lose the rental fee, face possible legal action........than to simply have your meeting on another day?

Nothing Zen; more like common sense.

Carey, thank you for the rational post.
I didn't think my original post was abusive either. Basically, it's attack the messenger. My intent in posting was to announce this mistake now, so that there is still time to fix it.

I have checked with HPP staff and it is true that the renter is not a HPP member or lot owner.
I also checked and the event is for a one year birthday party.

There is more than enough time to change this birthday party time, date or venue.
This conflicting date is 3 months away.

The general membership meeting should be the priority over a non-owner birthday party.

Regarding the comments about mainland attitudes, I was born on Oahu. Lived here since came back from VN. Married local, but I'm haole raised. We raised 2 boys who are adults with their own families here on Big Island. So my values are not from mainland.

As a big city lawyer and experienced mediator, I do not wish to attack the messenger; I only seek to offer Pro Bono advice to a dysfunctional entity.

1. Honor your legally binding contract (baby party, wedding, carwash, whatevas).

2. Announce the new date and time of your meeting(that's three months away).

3. Forgive the administrator, who after eighteen years of service, made this catastrophic error.

4. Practice stress mitigation techniques; Yoga, exercise, in extreme circumstances, ice cream.

Snor(K)le, as a "big city lawyer", you may never have BEEN to the general meeting (as there are no "big city"areas nearby!).
I have...Guess what? there are some property owners that PLAN THEIR VISIT HERE, based on the general meeting. Some have property that they rent, some have "their piece of Hawaii" as a future dream, some have investment property...

I think anyone can see that if it is in the bylaws what date & time the meeting is, & is sent in the homeowners newsletters to all 8,800 lot owners AROUND THE WORLD, that it is a little bit more than posting banners at the entrance!
This year is also a year, what with the storms, paving, & legal issues, that may have some lot owners having questions they would like to bring up at the general meeting, as is their LEGAL right....a meeting that is set by the bylaws....

So again I say:
Rent a tent, have the meeting at the required date & time, on Hui property, IF the renters are unable or unwilling to change their venue. that would solve all issues without the need to print banners & ruffle feathers of some property owners that have had enough ruffling for the year!

As I mentioned...there are usually contingencies in every contract, not knowing the contract I would not venture to say what the ones on this rental contract are...you seem to know, as a "big city attorney"...

And for those how don't find out about the new date for the HPP Membership meeting, they'll probably have more fun at baby's first birthday anyway.

Don't forget to videotape all of the great advice and best wishes the one year old child will receive from HPP members who didn't notice the meeting date changed, and don't realize where they are. (from a recent HPP thread):

What will this meeting accomplish anyway? Just pave the rest of the unpaved roads and then maintain them. How hard is that? Imagine if all you bickering people had to fight in WW2? Thank God for people like my great grandpa or we would all be slaves or dead.

OK...it seems that there are many here that do not realize that the JUNE meeting is the meeting that the elections results for the board members being voted on that year are reported...so for some, esp. those residing in the districts having a vote...well - moving the place, date &/or time is equal to moving the date, place &/or time of any large meeting, anywhere from a mild inconvenience to a major change...what it is to every single lot owner? I do not know, but do know that it COULD cause even more contention with the board....

The bylaws do contain contingencies if the time, place or date of a general meeting must occur....

but again...renting a tent & having everything else go according to the bylaws would be a way to make sure that it is not an onerous burden for some, esp those that travel here to attend the June meetings....
