TMT - Contested Case Hearing Status - Hilo
Keahi Warfield (from PUEO and KOYD) speaks about TMT and Mauna Kea to Ige and presents his own 10 point plan for the future for Hokukea on Mauna Kea.

For those who don't know, Hokukea is the educational telescope that Ige told the protestors he would remove to help pave the way for TMT by reducing the physical number of telescopes on Maunakea.

Strange as this may sound, Hawaii is not going to be trapped in La-La land forever.

At some point in the future, this state will stop being a supportive haven for fringe movements based on dubious legal, racial and chemical premises. Lawyers chasing the homeless and the reality-challenged like ambulance chasers on the mainland, will be shown the door.

When that day comes, what is your answer when your children and grandchildren read about the incredible discoveries being made in the golden age of astronomy with giant telescopes and ask you people,

"WHAT THE F WERE YOU THINKING TO KILL THIS THING? WERE YOU INSANE?'

Do I understand this correctly? The petitioner, who wants to prevent the TMT from being built on his holy mountain because a telescope would be a desecration of his beliefs and religion, has asked the court for a scheduled recess to celebrate the (I assume) Christian holiday, so he may personally take part in the festivities to perpetuate a religion which did everything in it's power through missionaries and lay followers to destroy all aspects of the Hawaiian culture, language, and religion?

Please someone, tell me I read that wrong.

Monday January 16th 2017 is Martin Luther King day, so watch out for an amended motion to avoid that day as well.

BREAKING NEWS RECEIVED AT 4:21PM AND CONFIRMED BY A PARTY TO THE RE-PERMITTING CASE:

RICHARD NAlWlEHA WURDEMAN issues a Notice of Withdrawal of Counsel.

Shortly after submitting a detailed, and largely compelling motion for reconsideration of removal of Hearings Officer (HO) Ricky Amano as hearing officer, Wurdeman submitted a formal Notice of Withdrawal of Counsel.

Aloha ahiahi, Mr. Tom (my aloha to Pam, and all).

I would hope by tomorrow morning, the proper documents will be filed advising change of counsel of record.

Want to add comment, however, need to think this through, as it is fresh information. Not to mention, the repercussions here on PW when commenting on "hot topics". Rumors, assumptions, and innuendo are useless at this point.

The facts of the hearing, including this new development, will be forthcoming on record. How this affects the timing of the hearing, if at all, is of concern.

Just want to point out that there is a big difference between "due" process and "perfect" process. Due Process means you get an opportunity to be heard. It doesn't mean that the opportunity is exactly when you want it to be, or for the length of time you want it to be, or that the result has to be what you want it to be. I've had trials where hundreds of millions of dollars were at stake and the trial was set for four days. Four! Could my team make every argument we wanted to? Of course not. But the Courts are full of cases, the Judges have limited time, and everyone thinks their case is most important.

Given how long this story has now been in the news (over a year now), everyone *should* have their act together and know their arguments cold. I can appreciate folks thinking they aren't getting enough time or opportunity, but from everything I've read, they are getting their "due."

According to that statement, counsel has scheduling conflicts and chooses to appear at his other appointments rather than represent clients at the TMT hearings? It could be emergency surgery that can't be rescheduled with his doctor, but short of that and considering the significance of this case, why aren't the other appointments rescheduled? If there's a choice that can reasonably be made?
