TMT - Contested Case Hearing Status - Hilo
Who are these people who don't want more jobs, I want to hear from them. Do they have a job?

The major issue with the EIS was that it concluded adverse cultural impacts

Kukiniloa,
Thanks for you input. Would you be able to provide more detail about the adverse cultural impacts?

So much has been presented about the effects of the observatories on Hawaiian culture and traditions on Mauna Kea, but it's difficult to find specific information.

1) What were Hawaiian pre-contact observances toward Mauna Kea?
2) Post contact?
3) Was it for ali'i only, or common people as well?
4) How did they get to the summit?
5) How many made the journey in an average year?

I ask these questions because in my collection of books, when I check the index in reference to Mauna Kea, almost nothing is listed. Historically, the White Mountain, is more an Invisible Mountain, with a brief mention of mining, and not much more.

Does anyone know more about the relationship between the Hawaiian people and Mauna Kea, preferably prior to statehood?

why aren't the protectors protecting the 1/3 of Oahu occupied by the US military?

"Selective protection" suggests that none of the following are "desecration":

The resorts (which burn more power than TMT ever could).

Cruise ships dumping sewage into the bay.

(For that matter, County sewer connections draining into the bay. Or the many cesspools.)

HELCO's oil-fired generators.

Managing vegetation with dangerous poisons.

The once calm and peaceful Mauna Kea summit area that was Kapu for most

So: "traditional cultural practice" would forbid most people from visiting the summit.

open season for tour vans full of tourists taking pictures of everything including the Hawaiians possibly

As noted, legitimate authentic "cultural practices" would never happen at the summit, so it's hardly "possible" that the tourists could take pictures of Hawaiians there. Unless these are "fake" Hawaiians putting on a show for the tourists? At 14000 feet. With oxygen masks. Traditional ones like the auli'i used to wear.

China or India may have other intentions over the next 70 years, or gain helpful data or intelligence from Hawaii's Tmt

Correct: China and/or India probably intend to get off this planet and stake a claim on the nearest habitable system; data from TMT would be extremely valuable. Meanwhile, the USians will still be arguing about which "tradition" has the "rights".

Maybe if we're really really lucky, South Park will lampoon the whole TMT debacle.

This mitigation, I can understand, is insulting to some.

If you felt the FEIS was negligent, why didn't you, or any one else, challenge it in a court of law back in 2010. There was plenty of public notice and discussion over a 2 year period prior to 2010. As it stands now, the document is binding because no one challenged the FEIS during the 60 day window after the document was accepted.

The contested case hearing continues with the TIO party.

The TIO party is from Delaware. They are not a local party from Hawaii, the others involved in this case thankfully are. I am a bit confused to why the TIO party would even be allowed to continue as a party in this contested case hearing. jmo

Everyone who petitioned, showed up on time, filed their paperwork as required was allowed to participate.

Interesting how groups from Hawaii receive 30 minute time limits and restrictions from the judge in this contested case hearing and the TIO group from Delaware is granted special treatment and Time.

The planned TMT site visitation atop Mauna Kea was also done in a very disrespectful and one sided way as well. jmo

Everyone has a 30 minute restriction on cross examination.

The visit to the mauna was not disrespectful. I watched all the testimony regarding this aspect and all the complaints revolved around misconceptions: Why didn't we get get to walk around? It was too quick. I wanted to measure the string, etc.

This group has had enough already.

The site atop Maunakey is unique in the world in its scientific importance for astronomical observation. It has no peer in the N. hemisphere. It cannot be made the hostage of deluded fanatics led by a haole who speaks the language and likes to dress up in Hawaiian garb, file lawsuits, and dictate 'Hawaiian culture' via lawyers and the courts.

TMT is the crown jewel of 21st Century high-technology and its loss is not only a huge loss for all the people of Hawaii and future generations here, but for the USA and ultimately, for the human race.

The time for playing lawyer games with neurotics and children is over. If Hawaiians want to follow someone who is not even ethnic Hawaiian and curl up in a foetal position and suck their thumb for the rest of human history that is fine, but they do not speak for the human race on issues of this level of importance.
