I was pointing out that the Supremes struck down Lingle's Act Two, not the Ferry itself...

Note that the emphasis is on the law not the Ferry.
Keep in mind, I was doing so to point to kalakoa's reference to the idea that Lingle could better serve the TMT, asking if another circumventing of our laws is what he was implying.
